These Sunbit Rewards Card Rewards Program Terms and Conditions (the “Terms and Conditions”) govern the Rewards Program (the “Program”) for the Sunbit Rewards Card. Your Sunbit Rewards Card account (the “Account”) is automatically enrolled in the Program. Use of your Account constitutes your acceptance of these Terms and Conditions.]
What are Rewards?
“Rewards” are rewards that you earn on Qualifying Purchases (described below) made with your Account subject to these Terms and Conditions. Rewards are redeemable as statement credits through the Sunbit app.
How do I earn Rewards?
You earn Rewards when you make Qualifying Purchases. The Rewards you can earn during a billing cycle equals 2% of the net Qualifying Purchases in that cycle.
What are Qualifying Purchases?
“Qualifying Purchases” are Purchases (as defined in your Cardmember Agreement) that post to your Account and for which you are eligible to earn Rewards. Qualifying Purchases do not include any of the following: finance charges; Account fees; payments; payment reversals; cash advances; balance transfers; account adjustments; transactions prohibited under your Cardmember Agreement; disputed transactions; cash-like transactions (e.g., purchases of wire transfers, money orders, traveler’s checks, foreign currency); money transfers; gambling-related transactions; crypto-related transactions; person-to-person (P2P) payments; loading prepaid cards or digital wallets; fraudulent transactions; and any transactions determined by us to have been conducted solely for generating Rewards. Transactions that are not Qualifying Purchases do not earn Rewards.
Is there any limit to the Rewards that I can earn or redeem?
No. There are no limitations on the maximum amount a customer can earn and Rewards do not expire for the life of your Account. However, you may also be ineligible to earn or redeem Rewards if your Account is not in Good Standing (described below).
How do you calculate my Rewards and what happens if there is a return, reversal or other adjustment to a Qualifying Purchase?
We calculate your Rewards in any given billing cycle by taking the sum of your Qualifying Purchases that post to your Account that billing cycle and subtracting any returns, reversals or negative adjustments that relate to Qualifying Purchases from the same cycle or any prior cycle(s). This gives us the net Qualifying Purchases for the cycle. We then multiply the net Qualifying Purchases by 2% to determine your Rewards for the billing cycle, and credit this amount to your available Rewards balance in the Sunbit app (“Rewards Balance”). Pending Rewards are not included in your Rewards Balance. It is possible for the net Qualifying Purchases in a billing cycle to be negative and, in this case, instead of crediting to your Rewards Balance, we will reduce your Rewards Balance by the amount of the negative Rewards, which may result in a negative Rewards Balance. If your Rewards Balance remains negative at the end of 3 consecutive billing cycles, we reserve the right to charge your Account for the amount of any negative Rewards Balance.
Example: If you made only a $1,000 Qualifying Purchase in one billing cycle, received a Rewards Balance credit in that cycle for $20 (reflecting a 2% rate), and you then returned the $1,000 Qualifying Purchase in the next billing cycle (and made no other Qualifying Purchases in that next billing cycle), in that next billing cycle we would reduce your Rewards Balance by $20. If your beginning Rewards Balance was $5, then the $20 reduction would result in a negative Rewards Balance of -$15.
Rewards you earn do not earn or accrue any interest, and you generally cannot rely on Rewards to avoid making a Minimum Payment due on your Account.
How does redemption work?
Redemption is not automatic. You must use the Sunbit app to redeem Rewards. Rewards can be redeemed by going to the “Rewards” tab of the Sunbit app. When you redeem Rewards from your Rewards Balance as a statement credit, the redeemed amount will be subtracted from your current Rewards Balance and applied as a statement credit to your outstanding Account balance. Rewards are only redeemable as statement credits through the Sunbit app and have no separate cash value.
A statement credit resulting from a Rewards redemption will first be applied to the amount of your outstanding Account balance in excess of any minimum payment due (“MPD”) and then any remaining statement credit amount will be applied to such MPD. Thus, redeeming Rewards as a statement credit will generally not extinguish your MPD obligation in a billing cycle unless the amount of such statement credit is at least equal to your outstanding Account balance. You can select the amount of your Rewards Balance that you want to redeem as a statement credit in the Sunbit app, with a minimum redemption amount of $1 and a maximum redemption amount equal to the value of your Rewards Balance. Pending Rewards cannot be redeemed as a statement credit until they become available in your Rewards Balance.
Example: If (1) you have a billing cycle that runs from January 15 to February 14, (2) you make $1,000 in Qualifying Purchases during that billing cycle, (3) there are no adjustments to your Rewards (e.g., due to returns, reversals, or other adjustments), (4) your Account is in Good Standing (as described below), and (5) none of the transactions are excluded from earning rewards, we will add an amount to your Rewards Balance on February 14 equal to $20. If on February 15 you redeem a $20 statement credit and (1) your outstanding Account balance is $35 and (2) your MPD is $25, then the statement credit will reduce both your outstanding Account balance and MPD to $15 but you will still be obligated to make a $15 payment to satisfy your MPD as set forth in your monthly statement.
How do I get information on my Rewards?
We will include information about your Rewards on each of your periodic statements and in the Sunbit mobile app. You may also be able to access such information through other means that we make available to you.
Can you prevent me from earning or redeeming my Rewards?
Yes. Only Accounts with a rewards-eligible status (in “Good Standing”) can earn or redeem Rewards. We may deem your Account as not in Good Standing in our sole discretion, including, without limitation, in cases where we suspect fraud or abuse, or other suspicious activity with respect to the Program or your Account, your Account is delinquent or in default, your Account is closed, or your ability to use the Account for transactions is suspended.
What happens to my Rewards if my Account is not in Good Standing?
Notwithstanding anything to the contrary in these Terms and Conditions, if your Account is not in Good Standing, we reserve the right, in our sole discretion, to not allow you to earn Rewards on Qualifying Purchases and/or redeem any Rewards you may have otherwise earned. Also, if your Account is delinquent or in default, we reserve the right to apply any Rewards as a credit to the outstanding balance of your Account at any time and without prior notice. In the event that your Account transitions from not being in Good Standing to being in Good Standing, we shall have no obligation to issue Rewards to your Rewards Balance for the period in which your Account was not in Good Standing.
Can I give my Rewards to someone else?
No. Rewards are not transferable.
What happens to Rewards if my Account is closed?
If you or we close your Account, you will not be eligible to earn further Rewards. If your Account is in Good Standing on the date your Account is closed, at the end of the billing cycle in which the Account is closed, we will issue you an Account credit (1) for any Rewards you would otherwise be entitled to receive through the date of closure (subject to adjustment for returns, reversals or negative adjustments) and (2) for any unredeemed Rewards in your Rewards Balance. If you or we close your Account and your Account is not in Good Standing, any unredeemed Rewards will be forfeited, subject to any grace periods required by applicable law. However, notwithstanding any other provision in these Terms and Conditions, in cases where we close your Account due to suspected fraud or misuse, any unredeemed Rewards will be immediately forfeited. If your Rewards Balance is negative on the date your Account is closed, we reserve the right to charge your Account for the amount of such negative Rewards Balance and you will remain obligated to repay that amount consistent with your Cardmember Agreement.
Can you change these Terms and Conditions or terminate this Program?
Yes. We reserve the right to terminate this Program or to change, delete from, or add to these Terms and Conditions at any time and for any reason. We will notify you of any changes to the Program.
Why are some words in these Terms and Conditions capitalized?
All capitalized terms are defined in these Terms and Conditions, or if not here, then in your Cardmember Agreement, which is incorporated into these Terms and Conditions by reference. For purposes of these Terms and Conditions, the pronouns “you,” “your,” “I,” and “my” are intended to mean the Cardholder (except that the pronoun “you” when used in the headings/questions means TAB Bank). The pronouns “we” and “our” mean TAB Bank and its service providers.
What laws govern these Terms and Conditions?
The laws of Utah govern these Terms and Conditions and the Program. This Program is void where prohibited by law. The Program is offered by TAB Bank and administered by Sunbit or one or more other third-party service providers. However, notwithstanding any other provision in these Terms and Conditions, these Terms and Conditions and the Program are subject to the Arbitration Provision in your Cardmember Agreement unless you were a member, or a dependent of a member, of the armed forces on the date you opened your Account, or (2) you reject the Arbitration Provision in the manner provided for in your Cardmember Agreement.
What should I do if I think there is a problem with my Rewards?
Please contact us immediately if you believe you are eligible for Rewards that you have not received, or that an error has occurred in the calculation of your Rewards. If we improperly deny, fail to credit or improperly reverse any Reward that you are entitled to, then, subject to applicable law, your only remedy will be to obtain that improperly denied or reversed Reward, or another comparable benefit we may determine in our sole discretion. Neither we nor any of our affiliates will have any other or additional liability to you or any other person for any such error(s).
